1. Introduction and Acceptance of Terms
Welcome to NextGen Compete ("NextGen Compete," "we," "us," or "our"). NextGen Compete is a recruiting readiness system designed for high school student-athletes, their parents and guardians, and coaches to navigate the college recruiting journey. By accessing or using our website located at www.nextgencompete.com, our mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use the Service.
These Terms constitute a legally binding agreement between you and NextGen Compete. We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
2. Eligibility and Account Registration
2.1 Eligibility
The Service is intended for individuals who are at least 13 years of age. We do not knowingly allow children under 13 to create or maintain an account. If we learn that an account belongs to someone under 13, we will close the account and delete associated personal information as described in our Privacy Policy.
When you create an account, you must provide your accurate date of birth (or confirm it when prompted). You represent that the date of birth you provide is true and complete. Providing false age information is a violation of these Terms and may result in suspension or termination of your account.
If you are 13 to 17 years old, you may create and use a student-athlete account. We strongly encourage you to link a parent or legal guardian to your account so they can follow and support your recruiting journey. Linking a guardian is recommended and optional; it is not required to access the Service's core features. Parents and guardians may create their own Guardian accounts and request a link to an athlete account through the features we provide.
If you are 18 or older, you may use the Service in accordance with these Terms and your selected account type (student-athlete, guardian, or coach).
By creating an account, you represent that you meet these eligibility requirements.
2.2 Account Types
NextGen Compete supports multiple user roles, each with tailored access to the Service:
- Student-Athlete Accounts: For high school student-athletes who access the full suite of recruiting readiness tools, including the Recruiting Checklist, Recruiting Readiness Score, School Tracker, Outreach Tools, and Events Discovery features.
- Guardian Accounts: For parents and legal guardians who may link to one or more student-athlete accounts to manage and support the recruiting journey on their behalf. Guardians may set up athlete profiles and manage recruiting activities through a linked dashboard.
- Coach Accounts: For high school and club coaches who access a dedicated dashboard for team management, roster oversight, athlete recruiting data (with permission), and competition tracking.
2.3 Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. This includes your date of birth and any information you provide when inviting or linking a parent or guardian. You must notify us immediately of any unauthorized use of your account. NextGen Compete is not liable for any loss arising from unauthorized access to your account.
3. Description of the Service
NextGen Compete provides a comprehensive recruiting readiness system that includes, but is not limited to, the following features and modules:
- Recruiting Checklist: A personalized, year-by-year checklist (9th through 12th grade) generated through a setup wizard based on the athlete's sport, position, graduation year, and target division. The checklist includes actionable steps, NCAA compliance guidance, key deadlines, and recruiting tips. Progress is tracked and exportable as a PDF.
- Recruiting Readiness Score (RRS): An objective confidence score (0–100) derived from a multi-dimensional assessment across six factors: Physical Traits, Athletic Performance, Mental Readiness, Support System, Network Strength, and Recruiting Progress. Results are stored with dimension breakdowns to help athletes understand where they stand and what to improve.
- School Tracker: A visual progress board where athletes track target schools through recruiting stages (Researching, Contacted, Visited, Offered, Committed, Signed). Includes school search with program detail sheets, coach information, roster data, visit logging, and outreach tracking per school.
- Outreach and Communications: A communications hub for managing coach outreach, including an email composer with smart-drafted templates, communication history with school attribution, response tracking, and multi-channel support.
- Events and Discovery: An event discovery and tracking system for camps, showcases, clubs, and tournaments, filterable by sport, event type, date range, and keyword. Includes attendance tracking and school affiliations per event.
- Coach Dashboard: Team management tools including roster oversight, athlete invitation system, recruiting readiness visibility across the team, and target school tracking for coaches.
- Guardian Features: Multi-athlete support with an athlete switcher, linked dashboards, and shared progress tracking. Guardians may initiate athlete profiles through an invitation and linking flow.
- Notifications System: A real-time notification system for updates related to your recruiting activities.
- Settings and Profile Management: Personal profile management, guardian link management, social media connections, highlight reel management, team affiliations, security settings, and activity history.
- Offer Evaluation and Financial Estimates: Tools to evaluate athletic scholarship offers, including cost of attendance calculations, coverage percentage estimates, net cost projections, and four-year financial projections. These estimates are derived from publicly available data sources and are provided for informational purposes only.
- Help and Support: A searchable, role-aware knowledge base and support contact form.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice.
4. Acceptable Use
You agree to use the Service only for its intended purpose of supporting the college recruiting journey. You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation, including NCAA rules and guidelines.
- Misrepresent your identity, age, athletic credentials, academic records, or any other personal information within the Service.
- Access or attempt to access another user's account without authorization.
- Use automated means (bots, scrapers, crawlers) to access, collect data from, or interact with the Service without our prior written consent.
- Upload, transmit, or distribute any content that is defamatory, obscene, threatening, harassing, or otherwise objectionable.
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
- Reverse engineer, decompile, or disassemble any aspect of the Service.
- Use the Service to send unsolicited communications to college coaches or other users in a manner that violates applicable anti-spam laws or NCAA regulations.
- Resell, redistribute, or commercially exploit the Service or any data obtained through the Service without our express written permission.
- Circumvent, disable, or otherwise interfere with security-related features of the Service, including bot defense mechanisms such as CAPTCHA verification.
5. User Content
5.1 Your Content
You retain ownership of all content you submit, upload, or transmit through the Service ("User Content"), including but not limited to athletic profiles, highlight reel videos, communication drafts, assessment responses, and any other personal information you provide. By submitting User Content, you grant NextGen Compete a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely as necessary to provide and improve the Service.
5.2 Content Standards
You represent and warrant that your User Content is accurate, does not infringe the intellectual property rights of any third party, and complies with all applicable laws and regulations.
5.3 Removal of Content
We reserve the right to remove or disable access to any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
6. Recruiting Readiness Score Disclaimer
The Recruiting Readiness Score (RRS) is designed to provide an objective, data-driven assessment of recruiting preparedness across multiple dimensions. The RRS is intended as an informational and motivational tool. It does not guarantee any specific recruiting outcome, college admission, athletic scholarship, or roster placement. The RRS is not a substitute for professional recruiting consultation, and NextGen Compete makes no representations or warranties regarding the accuracy, completeness, or predictive value of the RRS as it relates to individual recruiting outcomes.
7. Coach Outreach and Communications Disclaimer
The Service provides tools to help athletes and families communicate with college coaching staff. NextGen Compete does not guarantee that any outreach will result in a response, an offer, or any recruiting outcome. Users are solely responsible for ensuring that all communications sent through the Service comply with applicable NCAA, NAIA, NJCAA, or other governing body rules regarding permissible contact. NextGen Compete is not responsible for any consequences arising from user-initiated communications with college programs.
8. Financial Estimates and Offer Evaluations Disclaimer
Not Financial Advice: The financial estimates, cost of attendance calculations, scholarship coverage percentages, net cost projections, and four-year financial projections provided through our offer evaluation features are for informational and educational purposes only. These estimates do not constitute financial, investment, tax, or legal advice. NextGen Compete is not a financial advisor, and we do not provide personalized financial planning services.
Data Sources and Limitations: Financial estimates are derived from publicly available data sources, including but not limited to IPEDS (Integrated Postsecondary Education Data System) data, which may be incomplete, outdated, or inaccurate. Cost of attendance figures, tuition rates, fees, and room and board estimates are approximations based on historical data and may not reflect current or future actual costs. Actual costs may vary significantly based on individual circumstances, program selection, housing choices, meal plan options, and other factors.
User Responsibility: You acknowledge and agree that:
- You should independently verify all financial information with the educational institution and consult with qualified financial advisors, tax professionals, or college financial aid offices before making any financial decisions.
- NextGen Compete makes no representations or warranties regarding the accuracy, completeness, or timeliness of any financial estimates or projections.
- You will not rely solely on our estimates when making decisions about college attendance, scholarship acceptance, or financial planning.
- Actual costs, aid amounts, and net costs may differ materially from our estimates.
No Guarantee: We do not guarantee that our estimates will match actual costs, aid packages, or financial outcomes. Estimates are provided "as is" without warranty of any kind, express or implied.
9. School and Program Data
The Service may display information about college athletic programs, including coaching staff, roster data, academic details, and program statistics. While we strive to maintain accurate and current information, NextGen Compete does not warrant the accuracy, completeness, or timeliness of such data. Users should independently verify program information with the relevant institutions before making decisions based on data provided through the Service.
10. Intellectual Property
All content, features, functionality, design, graphics, trademarks, and technology comprising the Service — including the Recruiting Readiness Score methodology, checklist frameworks, scoring algorithms, and user interface design — are owned by or licensed to NextGen Compete and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
11. Third-Party Services and Links
The Service may contain links to third-party websites or integrate with third-party services (including authentication providers such as Google OAuth). NextGen Compete is not responsible for the content, privacy practices, or terms of service of any third-party websites or services. Your use of third-party services is governed by their respective terms and policies.
12. Payment and Subscription Terms
12.1 Subscription Plans
The Service is offered through two plans: a free plan ("Free") and a paid subscription plan ("Premium"). Free is available at no cost and includes access to core recruiting readiness tools subject to certain usage limits. Premium removes or raises those limits and unlocks additional functionality. The specific features and usage limits for each plan, together with current pricing, are described on our pricing page and presented to you at the time of enrollment, which control in the event of any conflict with a cached page or third-party listing.
12.2 Introductory Premium Access
When you create an account, you receive complimentary access to Premium features for an introductory period of fourteen (14) days (the "Introductory Period"). The Introductory Period does not require you to provide payment information to begin. At the end of the Introductory Period, your account automatically transitions to the Free plan unless you have elected to subscribe to Premium. This transition is not a termination of your account, and your data is retained as described in Section 12.8.
12.3 Pricing and Family Billing
Premium is offered on a per-athlete basis. As of the "Last Updated" date above, Premium is priced at $24.99 per month or $209.99 per year (equivalent to $17.50 per month) for each student-athlete, plus applicable taxes. Annual billing reflects a 30% savings compared to monthly billing. A Guardian Account (see Section 2.2) may subscribe more than one linked student-athlete under a single account; each additional student-athlete is offered at the family rate of $19.99 per month or $167.99 per year (equivalent to $14.00 per month), plus applicable taxes. Each student-athlete's subscription is billed separately under the same account. Current pricing is always shown on our pricing page and at checkout and controls in the event of any conflict with these Terms.
12.4 Billing and Automatic Renewal
When you subscribe to Premium, you authorize NextGen Compete and our third-party payment processor to charge the applicable fees to your designated payment method on a recurring basis. By subscribing, you represent that you are at least 18 years of age and are authorized to incur charges on the payment method provided, and you agree that the account holder is responsible for all fees incurred under the account, including subscriptions for any linked student-athletes. Your subscription automatically renews at the end of each billing period (monthly or annual, as selected) at the then-current price until you cancel. Before charging you, we will present the automatic-renewal terms in a clear and conspicuous manner, obtain your affirmative consent to those terms, and send you an acknowledgment and any renewal or price-change notices required by applicable law.
12.5 Cancellation
You may cancel your Premium subscription at any time through your account settings within the Service, without the need to contact us by phone or email. If you purchased your subscription inside our iOS or Android app, cancellation instead takes place in your Apple Account or Google Play account settings, as described in Section 12.9. Cancellation takes effect at the end of your then-current billing period; you will retain Premium access until that date and will not be charged for any subsequent period. Cancelling Premium returns your account to the Free plan and is separate from terminating or deleting your account, which is governed by Section 13.
12.6 Refunds
Except where required by applicable law, all fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, or features you did not use. Refunds for subscriptions purchased inside our iOS or Android app are handled by Apple or Google under their own policies, as described in Section 12.9.
12.7 Price Changes
We may change Premium pricing or the features included in any plan. For existing subscribers, we will provide advance notice of any price increase as required by applicable law, and the new price will apply to your next renewal following the notice period. Your continued subscription after a price change takes effect constitutes acceptance of the new price. If you do not agree to a price change, you may cancel as described in Section 12.5.
12.8 Effect of Plan Changes on Your Content
When your Introductory Period ends, or if you cancel Premium or it lapses, your account moves to the Free plan and your existing records are retained and remain accessible to you. Content you created or unlocked while on Premium or during the Introductory Period — including schools added to your School Tracker and school profiles you have unlocked — remains in your account. Free plan limits apply going forward to new activity. If your retained content already exceeds a Free plan limit, you will keep that content but may be unable to add more in the affected area until you upgrade or, for limits that reset on a periodic basis, until the next reset. Certain limits, such as the number of schools tracked in your School Tracker, are standing limits that do not reset over time and require an upgrade to Premium to increase. We do not delete your records solely because your plan changes; data retention following account termination is governed by Section 13.3 and our Privacy Policy.
12.9 Subscriptions Purchased Through the App Store or Google Play
If you purchase Premium inside our iOS or Android app, the transaction is processed by Apple or Google and not by us, and this Section 12.9 controls over Sections 12.4 through 12.6 to the extent of any conflict. Payment is charged to your Apple Account or Google Play account when you confirm the purchase. Your subscription renews automatically at the then-current price unless auto-renewal is turned off at least twenty-four (24) hours before the end of the current period, and your account is charged for renewal within twenty-four (24) hours before the end of that period. You can view, manage, and cancel the subscription, including turning off auto-renewal, in your Apple Account or Google Play account settings; we cannot cancel a store-billed subscription on your behalf. Cancelling a subscription in the App Store or Google Play does not by itself delete your NextGen Compete account, which is governed by Section 13. Refunds for these purchases are administered by Apple or Google under their respective policies, and we are not able to issue them directly.
12.10 Coach Accounts
Coach Accounts, including the Coach Dashboard and team-management features, are provided free of charge on both the Free and Premium plans. Nothing in this Section requires a coach to purchase a Premium subscription to access coach features.
13. Termination
13.1 Termination by You
You may terminate your account at any time through the account settings within the Service. Account deletion is subject to identity verification and security procedures, including CAPTCHA verification.
13.2 Termination by Us
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, if we determine that you have violated these Terms or if continued access to the Service poses a risk to other users or the integrity of the Service.
13.3 Effect of Termination
Upon termination, your right to access the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including Sections 10, 14, 15, and 16) will survive.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEXTGEN COMPETE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
NEXTGEN COMPETE DOES NOT GUARANTEE ANY SPECIFIC RECRUITING OUTCOMES, ATHLETIC SCHOLARSHIPS, COLLEGE ADMISSIONS, OR ROSTER PLACEMENTS AS A RESULT OF USING THE SERVICE.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEXTGEN COMPETE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL NEXTGEN COMPETE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNTS PAID BY YOU TO NEXTGEN COMPETE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
16. Indemnification
You agree to indemnify, defend, and hold harmless NextGen Compete and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, or your infringement of any third-party rights.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Alameda County, California. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
18. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and NextGen Compete regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
